These Terms of Service ("Terms") are a legally binding agreement between you ("you") and Muhammet Ali Topakkaya ("Lunest", "we", "us"), governing your use of the Lunest mobile application and related services at lunestapp.com (collectively, the "Service").

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

NOTICE: By using Lunest you agree to these Terms. Sections 15 (governing law/forum) and 12 (limitation of liability) deserve particular attention.

1. The Service

Lunest is a social platform offering: photo posts (single and carousel up to 10 images), styled overlay text baked into images, polls, 24-hour "stories" (dual-camera supported), direct messages, community chats, comments, likes, saves, mutual "friend" connections, and Apple Music song metadata attachments.

Key characteristics you should know:

  • Daily feed: Your home feed only shows posts created since midnight in your local timezone and resets every night. Posts are not deleted — they remain permanently in your profile diary.
  • Stories: Expire 24 hours after posting and are removed from our systems.
  • Messages: Are not end-to-end encrypted. They are encrypted in transit (TLS) but stored as readable text on our servers.
  • Online presence: Your online status and "typing" indicator may be visible to other users.
  • Story viewers: Story owners can see who viewed their stories. Message senders can see read receipts.

We may change, add, or remove features over time.

2. Eligibility & Accounts

  • Minimum age: You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), your parent or legal guardian must review and accept these Terms on your behalf; by registering you represent that they have done so.
  • Registration: You may register via email + password, Sign in with Google, or Sign in with Apple (iOS only). Email verification is required. Date of birth, full name, and username are required to complete a profile.
  • Accuracy: You must provide accurate information. Misrepresenting your age (including a child posing as 13+) is grounds for termination.
  • No impersonation: You may not create an account for another person or impersonate anyone.
  • Multiple accounts: You may use multiple accounts on one device; all of your accounts are bound by these Terms.
  • Accounts are non-transferable. You are responsible for all activity under your account; keep your credentials and verification codes confidential. Notify us immediately at [email protected] if you suspect compromise.

3. Your Content & License to Us

  • You retain ownership of photos, text, polls, comments, messages, and other content you post ("User Content").
  • License grant: By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable (only to our infrastructure providers) and transferable license to host, store, copy, process, resize, re-encode, display, and distribute your User Content as necessary to operate and provide the Service, consistent with the visibility settings you choose. This license ends when you delete the content or your account, except that (a) content already shared with others (e.g., a post card sent via DM) may remain visible to recipients, and (b) copies may persist in backups for a limited period.
  • Overlay text: Text you place on images is baked into the image pixels and also stored as plain text (for moderation and accessibility).
  • Your warranties: You represent that you own your content or have all rights needed to share it, and that you have permission from identifiable people in your content where required.
  • Polls: Your vote is recorded and linked to your account for deduplication and tallying; other users cannot see how you voted.

4. Music (Apple Music Metadata)

  • Songs attached to posts are metadata only — music is never embedded into images/videos and never distributed as files.
  • 30-second previews stream only from Apple's servers; full songs open in Apple Music via deep link. Your use of Apple Music is governed by Apple's own terms.
  • "Apple Music" attribution shown next to song metadata is required by Apple's guidelines and may not be removed or hidden.

5. Prohibited Content & Conduct

You may not (see also the Community Guidelines, which are part of these Terms):

  • Post illegal content of any kind — especially child sexual abuse material (CSAM), which results in immediate removal, permanent ban, and reporting to NCMEC (US) / relevant authorities (Türkiye).
  • Post nudity, pornography, or sexual content; graphic violence; hate speech; harassment, bullying, stalking, or doxxing; content promoting self-harm, suicide, terrorism, or extremism.
  • Infringe copyright, trademark, or other intellectual property rights.
  • Engage in fraud, phishing, spam, fake engagement, bots, or deceptive identity.
  • Endanger minors in any way, including soliciting minors or arranging inappropriate contact.
  • Reverse engineer, scrape, or automate access to the Service; circumvent security or rate limits; access others' accounts.
  • Share others' personal data without consent.
  • Upload malware or interfere with the Service's operation.
  • Use the Service from a country embargoed by applicable sanctions/export controls.

6. Moderation, Reporting & Enforcement

  • Reporting: Posts, stories, comments, and users can be reported via in-app "Report" tools. Reports are reviewed by our team.
  • Blocking: You can block any user; blocked users cannot interact with you or view your content.
  • User controls: DM privacy setting (everyone / friends only / nobody), per-post visibility (public / friends), message unsend, conversation deletion, comment deletion.
  • Enforcement: We may remove content, warn, suspend, or permanently terminate accounts for violations. Severe or repeated violations lead directly to termination.
  • Appeals: Email [email protected] to appeal a moderation decision.
  • We are not obligated to pre-screen content, but reserve the right to review, monitor, and use automated tools to keep the Service safe.
  • Do not post others' copyrighted content without permission. Rights holders may submit takedown notices under our Copyright / DMCA Policy, incorporated by reference.
  • We terminate repeat infringers.

8. Privacy

Our Privacy Policy explains what we collect and how we use it. Note in particular: DMs are not end-to-end encrypted, push notification titles may show sender or group names (DM bodies never contain message content), and your online presence is visible to other users.

9. Third-Party Services

The Service relies on third parties including Supabase (database/auth), Cloudflare R2 (media storage/CDN), Expo (push infrastructure), Google and Apple (sign-in), and the Apple Music API. Their own terms and policies apply. We are not responsible for third-party content or services reached through the Service.

10. App Store Terms

  • For the iOS app from the Apple App Store: Apple is not a party to these Terms and has no responsibility for the Service. Apple is a third-party beneficiary entitled to enforce these Terms. Apple has no support, warranty, or maintenance obligations; we do.
  • For the Android app from Google Play, Google Play terms apply.
  • There are currently no in-app purchases, ads, or paid features; these Terms will be updated if that changes.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL; (b) OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (CURRENTLY ZERO — THE SERVICE IS FREE) OR (ii) USD $100. Some jurisdictions do not allow these limits; where prohibited, they apply to the fullest lawful extent. Nothing in these Terms limits rights that cannot lawfully be limited (including consumer rights under Turkish Law No. 6502 and U.S. state consumer protection laws).

13. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your User Content, your violation of these Terms, or your violation of any law or third-party right.

14. Termination

  • By you: Delete your account anytime via Settings → Account Management → Delete My Account. Deletion permanently removes your profile, posts, stories, the messages you sent, and your media. Messages sent to you and content cards you shared may remain in recipients' views; "delete for me" likewise only removes your own view (backups purge within a reasonable period; legal retention obligations excepted).
  • By us: We may suspend or terminate accounts for violations. Upon termination, licenses for remaining shared copies and Sections 3 (license survival for shared content), 11–16 survive.

15. Governing Law & Dispute Resolution

15.1 Users residing in Türkiye

These Terms are governed by the laws of the Republic of Türkiye. For consumer disputes, the consumer courts/arbitration boards at your residence or the place of transaction have jurisdiction; otherwise, the courts and enforcement offices of İstanbul apply.

15.2 Users residing in the United States

Disputes arising from these Terms or the Service will be resolved in the competent state or federal courts of your state of residence or of the operator's location, at the election of the claimant; you retain access to small-claims court. These Terms are governed by the laws of the Republic of Türkiye, subject to the mandatory consumer-protection rights of your state of residence.

16. General

  • Language: If Turkish and English versions differ, the Turkish version controls for users residing in Türkiye; the English version controls elsewhere.
  • Severability: Invalid provisions do not affect the rest.
  • Assignment: We may assign these Terms in connection with a merger or sale; you may not assign them.
  • No waiver: Failure to enforce a right is not a waiver.
  • Notices: Notices to your account email are deemed delivered.
